EMPLOYEE SMS TEXT MESSAGING TERMS

Purpose Contracting Asphalt Employee Messaging Program

Purpose Contracting Asphalt, operated by Morawski Paving LLC, provides an optional internal SMS text messaging program for employees. The program may be identified as N.A.R.C. — Nagging Attendance / Automated Record Collector.

The program is used only for employment-related operational communications. It is not used for consumer marketing, advertising, promotional messages, or the sale of third-party products or services.

Types of Messages

Employees who voluntarily enroll may receive messages concerning:

• Clock-in and clock-out reminders or confirmations

• Attendance, tardiness, and absence follow-up

• Work schedules and schedule changes

• Job-site assignments, addresses, and directions

• Weather delays, cancellations, and operational updates

• Crew coordination and work-status requests

• Requests for job-site photographs, timesheets, or records

• Payroll-related confirmations and reminders

• Equipment, maintenance, and post-trip inspection reminders

• Safety notices and urgent work-related communications

• Other internal employment and operational information

Voluntary Consent

Participation in the employee SMS program is completely voluntary.

Consent to receive SMS messages is not a condition of applying for employment, being hired, continued employment, compensation, scheduling, receiving work assignments, or obtaining employment-related information.

Employees who decline SMS participation or later withdraw consent will receive equivalent operational information through another method designated by Purpose Contracting Asphalt, including telephone calls, email, printed schedules, or direct office communication.

Employees will not be penalized for declining or withdrawing SMS consent.

How Employees Enroll

Before receiving SMS messages, an employee must voluntarily complete and sign a standalone Employee SMS Text Messaging Consent Agreement.

The agreement identifies Purpose Contracting Asphalt as the message sender and explains:

• The types of messages the employee may receive

• That message frequency varies

• That message and data rates may apply

• How to obtain assistance

• How to withdraw consent and stop receiving messages

The signed agreement is retained in the employee’s records. After written consent has been documented, Purpose Contracting Asphalt may send a verification or confirmation message to confirm that the mobile number provided belongs to the employee.

Message Frequency

Message frequency varies according to the employee’s position, work schedule, active job assignments, seasonal operations, weather conditions, and daily business needs.

Messages may be more frequent during the active paving season and less frequent during the off-season.

Message and Data Rates

Message and data rates may apply according to the employee’s wireless carrier and mobile service plan.

Purpose Contracting Asphalt is not responsible for charges imposed by an employee’s wireless carrier for sending or receiving SMS messages.

Opting Out

Employees may withdraw consent at any time by replying STOP.

Employees may also notify the office in writing that they no longer wish to receive SMS messages.

After opting out, the employee may receive one final confirmation message. No further SMS messages will be sent unless the employee later provides new consent.

Additional recognized opt-out requests may include:

OPTOUT, CANCEL, END, QUIT, UNSUBSCRIBE, REVOKE, STOP, or STOPALL

Active Messaging Hours

Routine SMS messages will generally be sent during the following hours:

Monday through Friday, 8:30 AM to 7:00 PM Central Time

Routine messages will not normally be sent outside these hours, on weekends, or on holidays.

Exceptions may occur for genuine operational or safety-related emergencies, including urgent job-site incidents, severe weather cancellations, or last-minute schedule changes that cannot reasonably wait until the next business day.

Employees are not required to monitor or respond to SMS messages outside their scheduled working hours unless separately authorized and compensated in accordance with Company policy and applicable law.

Mobile Number Responsibility

Employees represent that the mobile number provided for enrollment belongs to them and that they have authority to consent to messages at that number.

Employees should promptly notify Purpose Contracting Asphalt if their mobile number changes or if they no longer control the enrolled number.

Privacy and Information Sharing

Mobile phone numbers, SMS enrollment information, and messaging consent records are used only for Purpose Contracting Asphalt’s internal business operations and administration of the employee messaging program.

Mobile information, phone numbers, SMS opt-in data, and messaging consent will not be sold, rented, or shared with third parties or affiliates for marketing or promotional purposes.

Information may be disclosed only when:

• Required by law, subpoena, court order, or lawful governmental request

• Necessary to operate the SMS service through telecommunications carriers, messaging providers, or service vendors acting on behalf of Purpose Contracting Asphalt

• Otherwise permitted under the Company’s Privacy Policy

Service providers assisting with message delivery may receive only the information reasonably necessary to provide those services and may not use employee mobile information for their own marketing purposes.

No Transfer of Consent

An employee’s consent applies only to messages from Purpose Contracting Asphalt for the internal operational purposes described above.

Consent is not transferred, sold, or provided to another business for its independent marketing or promotional use.

Changes to These Terms

Purpose Contracting Asphalt may update these SMS terms when necessary to reflect operational, legal, regulatory, or carrier requirements.

Material changes will be posted on this page. When required, employees will be notified and additional consent will be obtained before materially different categories of SMS messages are sent.
